Terms of Service

1. Acceptance of Terms
By registering for an account, accessing, or using Sproker (“Service”, “Platform”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any additional guidelines posted on the platform. If you do not agree, you must not use Sproker.
These Terms form a binding legal agreement between you and Sproker (“we”, “us”, “our”). You must be at least 13 years old to use the platform. If you are between 13 and 18, you confirm that your parent or guardian has read and agreed to these Terms on your behalf.
2. The Service
Sproker is a collaborative storytelling platform where users submit story premises (“plots”), contribute chapters, and vote democratically to determine which chapters become canonical. Completed stories may be licensed to publishers and studios via our marketplace.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use at hello@sproker.com.
You may not share your account, create accounts on behalf of others, or use automated means to create accounts. We reserve the right to terminate or suspend accounts that violate these Terms without notice.
4. Content Ownership and Licence
You retain full ownership of the original writing you submit to Sproker. By submitting content, you grant Sproker a non-exclusive, worldwide, royalty-free licence to display, reproduce, distribute, and sublicense your content as part of the collaborative story in which it appears, including for marketplace licensing under the royalty model described in Section 5.
This licence continues after you delete your account solely to the extent necessary to maintain the integrity of published collaborative works in which your content appears (e.g., a canon chapter that is already part of an approved story). You may not submit content that infringes any third party's intellectual property rights.
You represent and warrant that you own or have the necessary rights to the content you submit and that the content does not violate any law or third-party right.
5. Royalties and Revenue Sharing
When a story is sold or licensed through the Sproker Marketplace, revenue is split between creators (70%) and the platform (30%):
Chain Stories (public, collaborative):
- Plot owner: 30%
- Canon chapter authors (shared pro-rata by chapter count): 40%
- Platform: 30%
Solo and Writing Room stories (private/invite-only):
- Author: 70%
- Platform: 30%
Voters receive platform recognition (badges, XP) but no fiat royalties.
Print royalties:
For physical book sales through the Sproker Print Shop, royalties are calculated on net profit (retail price minus cost of goods) rather than gross revenue. The same 70/30 creator/platform split applies to the net profit amount.
Referral commissions:
Referrers earn a 10% recurring commission on revenue generated by their referred users. This commission is deducted from the platform's 30% share and does not affect creator payouts.
Payouts:
Royalties and commissions are accrued in your Sproker account balance in the currency of the original transaction (EUR or USD). The minimum payout threshold is €50.00 or $50.00. Payouts are processed via Stripe.
Sproker reserves the right to adjust the revenue split model with 30 days' advance notice to registered users. The updated split will apply only to new marketplace transactions concluded after the notice period.
Pro and Ultra subscription holders benefit from the royalty multipliers described on the pricing page.
6. Voting and Canonisation
Community voting determines which submitted chapter becomes canonical for each story slot. Votes must be cast in good faith. Vote manipulation, including creating multiple accounts to vote, coordinating inauthentic voting groups, or using automated tools to cast votes, is strictly prohibited and will result in immediate account termination and forfeiture of any accrued royalties.
7. Prohibited Content and Conduct
You may not submit, upload, or share content that:
- Is unlawful, threatening, defamatory, or harassing
- Infringes any copyright, trademark, or other intellectual property right
- Contains child sexual abuse material (CSAM) or any content sexualising minors
- Is hateful or discriminatory based on race, gender, religion, sexuality, or other protected characteristics
- Promotes violence or self-harm
- Contains malware, phishing links, or other malicious code
- Constitutes spam or unsolicited advertising
We may remove content and terminate accounts that violate these rules at our sole discretion, without prior notice.
8. AI-Generated Content
Sproker provides AI-assisted writing tools as part of paid subscriptions. You are responsible for all content you submit, including content generated with AI assistance. You must disclose whether a submission is AI-assisted using the platform's built-in toggle.
Story authors may choose to exclude AI-assisted submissions from their story. This preference is displayed publicly and must be respected.
9. Subscriptions and Payments
Sproker offers free and paid subscription plans (Pro and Ultra). Paid plans are billed monthly or annually via Stripe. By subscribing, you authorise recurring charges to your payment method.
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.
AI credits purchased separately are non-refundable and expire as described on the pricing page.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, Sproker and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) the Service, even if advised of the possibility of such damages.
Our aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the total fees you have paid to Sproker in the 12 months preceding the claim or (b) €50.
12. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will notify registered users by email and require re-acceptance before continued use of the platform. The version identifier and “Last updated” date at the top of this page reflect the current version.
Your continued use of Sproker after a new version takes effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
