Please read these Terms carefully before using Sproker. By creating an account or using our service you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By registering for an account, accessing, or using Sproker (“Service”, “Platform”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any additional guidelines posted on the platform. If you do not agree, you must not use Sproker.

These Terms form a binding legal agreement between you and Sproker (“we”, “us”, “our”). You must be at least 13 years old to use the platform. If you are between 13 and 18, you confirm that your parent or guardian has read and agreed to these Terms on your behalf.

2. The Service

Sproker is a writing studio. You write stories in it, alone or with people you invite, with a writing assistant you can ask for help. You can export what you write at any time and order printed copies of it.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use at hello@sproker.com.

You may not share your account, create accounts on behalf of others, or use automated means to create accounts. We reserve the right to terminate or suspend accounts that violate these Terms without notice.

4. Content Ownership and Licence

You retain full ownership of the writing you create on Sproker. You grant Sproker a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your content only as far as needed to run the Service for you: to show it to you and to the people you choose to share it with, to produce the exports and printed copies you order, and to keep backups. We do not sell, license or publish your writing.

When you write chapters in a story that someone else started and invited you to, this licence continues after you delete your account only as far as needed to keep that story whole for its owner and the other people in it. You may not submit content that infringes any third party's intellectual property rights.

You represent and warrant that you own or have the necessary rights to the content you submit and that the content does not violate any law or third-party right.

Administrator access. Sproker administrators may access content you have not published, including drafts, to improve the platform and understand how it is used, and where necessary for support, abuse prevention, or legal compliance, as described in our Privacy Policy. Every such access is logged internally with the administrator's identity and a stated reason.

5. Exporting and Printing

Your writing is yours to take elsewhere. On every plan you can export your stories, for example as PDF, EPUB or Word, and use them as you like, including with another printer or publisher. Sproker takes no share of anything your writing earns outside Sproker.

You can also order printed copies of a story through Sproker. A printed copy is sold at the price shown at checkout, which covers printing, shipping and our service. Sproker does not pay royalties on printed copies, including copies ordered by people you invited to a story.

Earlier versions of these Terms described a revenue split, tips and supporter subscriptions. Those features have been discontinued.

6. Prohibited Content and Conduct

You may not submit, upload, or share content that:

  • Is unlawful, threatening, defamatory, or harassing
  • Infringes any copyright, trademark, or other intellectual property right
  • Contains child sexual abuse material (CSAM) or any content sexualising minors
  • Is hateful or discriminatory based on race, gender, religion, sexuality, or other protected characteristics
  • Promotes violence or self-harm
  • Contains malware, phishing links, or other malicious code
  • Constitutes spam or unsolicited advertising

We operate a notice-and-action process: anyone can report content they believe is illegal or breaches these rules by emailing privacy@sproker.com. When we restrict or remove content or suspend an account, we will give the affected user a statement of reasons and information on how to object, in line with the EU Digital Services Act. We may act without prior notice only where necessary to comply with the law or to prevent imminent harm.

7. The Writing Assistant

Sproker provides an AI writing assistant. Its actions are paid per use from AI credits on every plan, and the price of an action is shown before you start it. You are responsible for all content you submit, including content written with the assistant's help. Text the assistant suggests enters your story only when you choose to keep it.

8. Subscriptions and Payments

Sproker offers a free plan and a paid plan (Pro). Pro is billed monthly or annually via Stripe. By subscribing, you authorise recurring charges to your payment method. AI credits are bought separately from a plan.

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

Right of withdrawal (EU consumers). If you are a consumer in the EU you normally have 14 days to withdraw from a purchase. For digital content and services (subscriptions and AI credits) you expressly ask us to begin immediately and acknowledge that you lose the right of withdrawal once performance has started - so the current period and any used AI credits are non-refundable. Personalised printed books are made to your specifications and are exempt from the right of withdrawal once production begins, except where they arrive damaged or defective. To withdraw where the right applies, email privacy@sproker.com.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Sproker and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) the Service, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the total fees you have paid to Sproker in the 12 months preceding the claim or (b) €50.

11. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will notify registered users by email and require re-acceptance before continued use of the platform. The version identifier and “Last updated” date at the top of this page reflect the current version.

Your continued use of Sproker after a new version takes effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Disputes will be subject to the competent Dutch courts. If you are a consumer, the mandatory consumer-protection rights of your EU country of residence are not affected by this clause.
